What are Safe Haven Laws?
Safe Haven Laws, also known as Baby Safe Haven or Safe Surrender laws, are state laws that allow parents to legally and anonymously surrender their newborn infants at designated safe locations, such as hospitals, fire stations, or police stations, within a specific time frame after the baby’s birth. If a young mother or young couple realizes that they cannot care for their newborn baby, they can utilize this safe alternative, knowing that their baby will be taken care of and that they will not be subject to criminal liability for abandonment. Safe Haven laws prevent tragic outcomes for both infants and their parents.
Arizona’s Safe Haven Law
Infant Safe-Haven Laws in Arizona protect infants and support new birth parents. Under Arizona’s Safe Haven Law, a parent or legal guardian can surrender an infant up to 30 days old to any emergency medical services provider, hospital staff, or licensed medical staff. The law guarantees that the infant will receive appropriate care and be placed in the care of Child Protective Services, which will place the baby in a foster home and seek an adoptive family.
When an infant is left with a private child welfare or adoption agency that can arrange for adoption, the agency must notify Child Protective Services within 24 hours, confirming that it will take custody of the baby. Parents still have a window of time in which they have the right to change their minds even after surrendering their baby.
